FRANKFORT Franklin Circuit Judge Thomas Wingate granted intervener status to the Family Foundation in the Kentucky Horse Racing Commission's so-called "Instant Racing" case.
The state has asked the court to rule on whether it properly put out regulations to allow betting on previously run races.
Wingate indicated on Wednesday morning that he will allow all parties to file briefs in the case but intends to limit discovery.
He also said he wants a better understanding of how "Instant Racing," or wagering on historical races, works.
